Homeowner Bill of Rights proposed
About a year ago, AARP proposed a Bill of Rights for homeowners. The organization has now published an article by Houston attorney David Kahane in which he outlines a Bill of Rights for members of property owners associations. Our request to reprint the entire set of ten rights was denied by AARP, but permission was given to quote from the article. Above are numbers one and six of the ten. Below are two of the ten rights contained in Kahane’s article.
I. The Right to Security against Foreclosure
An association shall not foreclose against a homeowner except for significant unpaid asses-ments, and any such foreclosure shall require judicial review to ensure fairness.
VI. The Right to Individual Autonomy
Homeowners shall not surrender any essential rights of individual autonomy because they live in a common-interest community. Homeowners shall have the right to peaceful advocacy during elections and other votes as well as use of common areas.
